Terms of service

By creating an account or using PoodyPi you agree to these Terms and to the Privacy policy. They include an assumption of risk (section 2), limits on our liability (sections 10 and 11) and an agreement to settle disputes by individual arbitration (section 13). If you don't agree, don't use PoodyPi.

1. What PoodyPi is

PoodyPi is an app for gyms: the schedule, who's in, sparring, posts, clips and messages. Each gym is run by its owner and coaches, not by us. We make the app. We don't run your gym, coach you, check who you train with, or supervise anything that happens there.

2. Training is at your own risk

Combat sports and training carry a real risk of injury. PoodyPi gives no training, medical or safety advice, and nothing in the app — a class on the week, a sparring card, someone accepting your ask — means a session, a partner or a gym is safe or suitable for you. That's between you, your coach and your doctor. To the fullest extent the law allows, you take on that risk and release us from claims arising from training, sparring, events or anything else that happens at or through a gym.

3. Who can use PoodyPi

Anyone a gym gives a code to. If you're under 18 (or under the age of majority where you live), you may use PoodyPi only with the permission of a parent or guardian, who agrees to these Terms for you and is responsible for your use of PoodyPi. A parent or guardian can ask us to see or delete their child's data at supportkao@gmail.com.

4. Your account

Tell us the truth about yourself, including your date of birth — it decides what the app lets you do. One person per account. Keep your password to yourself; you're responsible for what happens under your account. Don't pretend to be someone else.

5. Gyms, owners and coaches

A gym's owner decides who's in it and can take anyone out, without notice, or delete the gym and everything in it. Owners and coaches set the schedule, can pin and delete posts, and can switch messages off for their gym. Anything you pay a gym, and anything you agree with it, is between you and the gym — PoodyPi takes no payments. We aren't responsible for how a gym is run or for disputes between a gym and its members.

6. What you post

What you post is yours. So we can run PoodyPi, you give us a worldwide, royalty-free, non-exclusive license to store, copy, process and show it to the people it's meant for — your gym, your connections, the people in a chat — and, for a clip you make public, to anyone on PoodyPi. The license ends when you delete the content or your account, except for copies we must keep by law or to deal with a report. You must have the right to post it, including the agreement of anyone recognizable in a photo or clip.

7. What's not allowed

There's a line between hard training and abuse, and it applies here. Don't:

• bully, harass, threaten or stalk anyone
• post hate speech or slurs about race, ethnicity, religion, sex, gender, sexual orientation, disability or any other protected trait
• post anything sexual involving a minor — it will be removed and reported to the authorities
• post nudity or sexual content
• photograph or film anyone without their agreement, and never in a changing room or bathroom
• share anyone's private information
• encourage self-harm or violence outside the sport
• post anything illegal or that infringes someone's rights
• spam, scam, phish or spread malware
• scrape, reverse-engineer or interfere with PoodyPi or its security.

8. Reports, blocking and removal

Report anyone from their profile or a chat, or by emailing supportkao@gmail.com. We look at every report within 24 hours and can remove content and suspend or ban accounts. You can block anyone at any time. We may suspend or end any account, at any time and for any reason, with or without notice, and we aren't liable to you for doing so. You can stop using PoodyPi and delete your account whenever you like.

Copyright: send notices with the information the law requires to supportkao@gmail.com. We remove infringing content and close the accounts of repeat infringers.

9. Other services

PoodyPi runs on services from other companies — hosting, storage, email and push notifications — listed in the Privacy policy. We aren't responsible for their outages or for anything outside our agreements with them.

10. No warranties

POODYPI IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T PROMISE THAT POODYPI WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT A SCHEDULE IS ACCURATE, OR THAT ANY GYM, COACH OR MEMBER IS WHO OR WHAT THEY SAY. WE AREN'T RESPONSIBLE FOR WHAT USERS POST OR DO.

11. Limits on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE AREN'T LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, PERSONAL INJURY FROM TRAINING, OR EMOTIONAL DISTRESS, ARISING FROM POODYPI OR FROM ANY GYM'S OR USER'S CONTENT OR CONDUCT. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND USD $100. Some places don't allow some of these limits, so some may not apply to you.

12. Indemnity

You'll cover us, and defend us, against claims, losses and costs (including reasonable legal fees) that come from what you post, how you use PoodyPi, or your breaking these Terms or the law.

13. Disputes

Email us first — most things get sorted that way — and give it 30 days before filing anything. Otherwise, to the extent the law allows, you and PoodyPi agree to settle any dispute by BINDING INDIVIDUAL ARBITRATION, not in court, and YOU AND POODYPI GIVE UP THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. Arbitration is run under the rules of a recognized arbitration provider in Camden County, New Jersey. You can opt out of arbitration by emailing us within 30 days of first agreeing to these Terms.

14. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Subject to section 13, any court case belongs in Camden County, New Jersey.

15. Changes

We may change, pause or end any part of PoodyPi at any time. We may update these Terms; we'll say so in the app when the change matters. Using PoodyPi after that means you accept them.

16. The rest

If part of these Terms can't be enforced, the rest still applies. Not enforcing something isn't giving it up. You can't transfer these Terms; we can. They're the whole agreement between you and PoodyPi about the app.
